WARNING: DECC (EPA) are proposing NEW noise laws.

The following link is the Regulatory Impact Statement (RIS) that DECC have issued to assist with the introduction of the proposed laws.

The following is my rough outline and by no means a complete overview of the proposed laws that DECC will be presenting to the government.
Clause. 18
"Noise control equipment to be properly maintained"
A person must not cause or permit a motor vehicle to be used on a road or road related area if:
The motor vehicle's noise control equipment allows the emission of more noise than the original noise control equipment fitted by the vehicle manufacturer, or
if an authorised officer (police etc) reasonably believes the equipment has been modified in a way that makes it less effective than it would have been if the modification had not been made, or
the motor vehicle's noise control equipment is not securely in place, or
a temporary noise reduction device is fitted to the vehicle (like a removable baffle, even if it is fitted and the vehicle is compliant to it's noise requirements) or
if the equipment allows gas to escape from a place other than the intended exhaust outlet.
And
A person must not:
Remove, or
render less effective, a motor vehicle's noise control equipment, otherwise than for the purpose of repairing or replacing it, or
replace a motor vehicle's noise control equipment with noise control equipment that is less effective than the original noise control equipment fitted by the vehicle manufacturer.
Fine: $200 *
* Penalty levels
The maximum penalties provided under the Noise Control Regulation for a "Court prosecution" are currently $16,500 for individuals and $33,000 for corporations.
DECC said of Clause 18; The aim of clause 18 is to provide a means of detecting noisy vehicles that avoids the cost and time associated with noise testing where it is not strictly needed. Noise testing is often not required to identify the fact that a motor vehicle's noise control equipment is defective, and a simple visual test and aural check is all that is needed. However, in cases where noise control equipment is modified and the officer is unsure whether the noise control equipment is less effective, a noise test should be carried out. Noise tests are often carried out by DECC authorised officers to support the finding of defective noise control equipment. In practice, a Police Officer's ability to carry out noise testing is limited by the cost of the equipment, lack of trained personnel, and competing priorities.
Use of informed subjective (guessing!) assessment to decide a noise offence is central to NSW noise legislation. The concept of offensive noise underpins the legislation. Powers under the POEO Act and existing Noise Control Regulation enable officers to exercise judgement in deciding whether noise is an issue.
DECC urges stakeholders to provide feedback on the new Regulation.

noise control equipment! why cant the dick heads say exhaust!!! Isn't having a aftermarket pipe which doesn't have the db's on it etc still illegal? The sticker or badge thing that is.

Nahh that was overturned after a major mail campaign by the MCC last year. No longer applies, and if any copper tries to book you for it send a coppy of the infringement to the MCC and they will tell you how to get it thrown out and make said copper look like a complete dick at the same time.
People what we do need is a repeat of what happened last time, that is thousands of submissions from all types of vehicle owners on how unjust etc this is. If anyone is aware of studies undertaken by reputable institutions then by all means make reference to them if they say loud pipes save. Otherwise the idea is to bombard these bastards with so many complaints they won't know what hit them. But makes the complains logical and based on common sence. Telling the DECC to Fu<k off wont work.

i dont mind a nice sounding exhuast note but it shits me to tears hearing a bloody loud hog scream up ya street where its so loud that you cant even hear ya tv. Also those f#$kin young p platers/ drivers in their cars as they like to flat foot it down the road in the middle of the night and hearing bass from their subs. Dont mind a nice car and sound system but have some bloody curtisy to others.

I don`t know why they bother with all that shit.
If a copper wants to give someone a hard time, be it for something written into legislation or not, they will and do so.

It's explained in the first post. It's to free the coppers up from sending cars, bikes etc over the pits. By this so they don't have to babysit the DECC inspectors under the guise of an RBT for pulling you over and then handing you over to the DECC for a noise test before your allowed to leave. Now they will be able (if this gets through) to pull any vehicle over and isse a $200 fine because jo bloggs copper with hearing damage from years on the job "thinks" your vehicle is too loud. This is not just bikes either, it will be all road going vehicles that are registered. As usuall they are trying to slip this in with a raft of other changes that effect noise curfews etc. Follow the link to the PDF in the first post and have a read, theirs a lot more to this than just our bikes aftermarket exhausts.

Im japan they have a JMCA tag to pass noise emissions.
This basically means they will pull you up just for the sake of it just to slap you with a $200 fine.

We are having some success by the sounds of it. I know I've seen a couple of Apprillas with factory removable baffles, but buggered if I know what their models are.

The MCC of NSW needs information on STOCK motorcycle exhausts with removable
baffle(s), end plates, plugs or any type of object that may be readily
removed with the types of tools supplied with a bike.

Why do we need this info? If we can show that there are m/c's on the road
with stock standard pipes that are fitted with noise suppression devices
that are not substantially fitted then the EPA will drop the proposed law
that will make it illegal to have such devices.
We need images(.JPG), models, year of manufacture etc
THIS IS IMPORTANT it will greatly assist our fight against the proposed new
DECC (EPA) laws.

The issue is the outlawing of "spuds", but the MCC are trying to get physical evicence of some of the more obscure manufacurers using them as OEM. :ayyy:

I had a set of pipes on my Harley (Don't boot me out admins I have already sold it & will never own one again promise) & never once got stoped on it but get this on a ride with a few of the boys one day they all have sport bikes & we all got stoped. The cops whent right through them pipes, rego lable holders the lot & didn't even look at me just said nice bike have a good day.

my race yoshie has a removable baffel pipe. Simple little alen key does the job for me. Ill have to have a look at my stock pipe and see what thats like.
