ok some young guy fresh out of police academy with nothing better to do than give tickets out.
Coming to work this morning with traffic crawling along as usual on the M$ carpark. I was putting along when i came up to thee cop car on the side of the road. Was too late as he saw me.
So anyways he was only interested in giving me a ticket. The ticket is for passing on left side of vechile and 2 points and $135.
Qu. i want to know is this the right ticket? Ok yes maybe i did pass left of vechile but i was in the break down lane. Is there anther way or ticket that you would be given instead of this. Im just thinking maybe i could take that to court as i was off the road so to speak and not passing car in anther lane. But than the break down lane is a lne or is it not?:confused1:

I thought that you could pass on the left of a vehicle now, provided it was safe. Check out traffic rules, rule 141 I think it was, section c??

Well if you go to court explaining that you lost power. pulled over into the breakdown lane as soon as safely possible... then realised it had hit reserve, so you leaned down and put it on reserve... At the moment when you were trying to re-join the traffic is when the traffic cop noticed you and was not interested in what actually happened....

You were in the break down lane you are as the Germans say "kaput". Although Oggies defence is certainly a plausible one and worth sending a letter off for. Just make sure you bike is not fuel injected as this defence will probably die in the ass.

well i didn't say anything i just sat there and he told me you know you cant travel down the break down lane. Gave me the ticket and said you cant pass on the left side. Had the camera going but i came up from behind. Once i pulled in just coming up behind he put his siren on and drove along behind me. So than i pulled over. Already had checked up on me as he asked if i was Dylan.

No, the fine should be for drive on or over continuous white edge line, which is $189 and 2 points, i know, that is the one i got coming back from motogp.

You didn't know it's illegal to be driving in the Breakdown lane? :confused1:

Ive seen motorcycle coppers following other motorcyclists in the BD lane in peak hour on the M4 without paying the slightest amount of interest in them......Must be if the copper is in a good mood or not.

its not a matter of knowing if im in the wrong or not. Its the fact that if he has writtern the wrong ticket for the crime. They want to issue tickets than they should know which ticket for the penalty.

possibly, but you may also get neg driving and driving in a dangerous manner... Not my opinion, a answer from someone in the know... He also said that the current ticket would more than likely stay as that is what you were doing and busted doing... :rules: who needs them

Depends on the copper/time of year (ie: Double demerits...)

I've been booked for this before and in Canberra loads of ppl do this every single day...been using it for last 8 years and even driven past coppers and never had an issue but one day I got one of 'those' coppers and yes got booked for it - went to lawyer and still no joy.....(and this was a NSW copper in ACT!!!)

I figured the cost of using this lane for so many years was only 1 fine then I sorta got over it....still - feel ya pain!

wqay i see it the rtaffic was crawling along. I was keeping left as sign says on freeway. You can pass left of vechile on multi lane if deemed safe. I was only going about 50-60klm/h, which was just a tad faster than the cyclist i just passed which he passed me with the cop just getting pulled over.
Ive passed cops b4 and just yesturday i did that with a 4 car pile up under the M7 as alway there are.
Every single day this week has been aco's on the M4 and i see it safe as well to put down the side in heavy traffic.

Good point mate, take it to court and see exactly what else they can write up ontop of existing one.

ps, Your not going to get off with that one either, as you were overtaking on the left hand side. Add to this more tickets, court costs, time off work, is it really worth it ? Sorry Dylan, best to just cop it sweet sometimes, and this is one of them.

What happens if they throw that one out and give you the correct one instead? an extra $50 on the fine, and possibly court costs? maybe tarrasque and I should take ours to court and try and get the lesser fine. (we both got done together. bloody cop)

Just for the arguments sake...

In NSW you are allowed to pass a vehicle on it's nearside if you are indicating left and turning left in the same lane or if you are on the left side of a broken line such as in an adjoing left lane.
You are allowed to pass on the offside if indicating right and you are on the left of either a broken or unbroken line in the same lane or on the right side of a broken line in another lane or overtaking. In other words if the lane is wide enough for you to share with another vehicle you can legally pass on its right side if indicating.

However, ADR 140 says do not overtake when unsafe; ARR 144 says to keep a safe distance when overtaking... So who decides its safe etc?? The NSW police..

Mate for a $135 and 2 points, i'd just be taking it on the chin, it'd cost you more than that too take it too court!
